When bringing a contractual claim after a successful M&A transaction, it’s essential to ensure that the claim notice is valid. Congratulations to Christopher Stothers, Rutger Kleemans and Dr. Stephan Dorn on their success at the Unified Patent Court’s Court of Appeal in relation to Christopher’s application to access Ocado’s statement of claim in the Ocado v Autostore proceedings. The Unified Patent Court (UPC) is a new European court dedicated to hearing patent disputes, which opened its doors in June 2023. Under the UPC’s rules of procedure, written pleadings and evidence shall be made available to the public upon a “reasoned request”. The Court of Appeal confirmed that, on the facts, Christopher was entitled to access Ocado’s statement of claim. This is a pivotal decision in that it sets out the UPC’s approach to transparency and open justice. Read more: https://okt.to/ZB1qxF
