    This is a fascinating development. While there is room for mischief if the funding misaligns incentives and the devil is in the (likely undisclosed) details, litigation funding directed at litigation that otherwise would have been brought (as what is effectively a hedging mechanism) is probably closer to the goals and structure of pure existing financing, and something that, if properly disclosed and ethically handled, is worth encouraging (or at least allowing) from a policy perspective. In my mind, if words match actions, it's a marker of a maturing market. As long as the availability of financing doesn't translate into forcing arbitrage opportunities or NPEs that otherwise wouldn't exist, individual client's control is respected and complete, and it's disclosed, I don't see the harm in it as a (regulated) financial product.Kudos to the firm and the funder for announcing it.

    There is much to unpack in Robert Dillard's article in Bloomberg Law but I was particularly struck by the fact that there seems to be so much focus on single case opportunity funding, whether directed through the claimant or acting law firm. The advantages of portfolio funding- as my current doctoral research at the University of Westminster and my day-to-day deal management are showing- are many and varied, so why is portfolio funding not growing more quickly?
